Policy Governing AI Generated Works

Today, at their monthly meeting, the Board of the Oklahoma Society for Culture Appreciation passed a resolution to adopt a policy recommended by the Board’s Committee for Policy & Administration on works of art or materials generated in full or most part by the use of Artificial Intelligence systems & tools. 

The use of AI to generate these materials has presented a quandary that isn’t easily rectified. Additionally, the revelations that some of these popular tools, sites, and apps have trained their networks on images and videos sourced in (generously) questionable manners, and without providing the option to the creators of these works to opt in or opt out of their use in these networks has caused us to review the situation with perspective on the challenges of the ethics of utilizing materials in this way and on the reality of the treatment of artists in popular culture and everyday life. We have passed a policy that we believe, at the very least, allows us to ethically proceed. 

 

Our Policy is as follows: 

  1. Until further notice, the sale of materials generated in whole or in most part by any AI system by any Artist, Vendors, or Exhibitors (third parties) is strictly prohibited in Shopping Bazaars at events produced by OS4CA. 

  2. Third Parties found in violation of this ban will receive one (1) warning to remove the offending material from the premises and/or cease the sale of digital materials. Failure to comply will result in immediate termination of their permission to vend, revocation of any event entrance passes, and the removal of the party for the remainder of the event.

    1. Determination for Warning and/or Removal shall fall to the Head of Shopping Bazaar Operations and/or the Director of Sales.

  3. We understand that some artists use legitimate assistive AI tools in the creation of their original artworks. This ban will not affect those works, but these works must be properly identified.

  4. This policy is to be stipulated in the agreements between the Company & any third parties.

Additionally:

  1. The Company and its staff are prohibited from producing artworks using the above mentioned tools or knowingly contracting to receive works produced using the above mentioned tools.  

    1. We understand that some artists use legitimate assistive AI tools in the creation of their original artworks. This ban will not affect those works, but these works must be properly identified.

    2. This policy is to be stipulated in the agreements between the Company & any third parties contracted to produce works for the company.

    3. Any third party contractors found to be in violation of this agreement will be barred from future contracts for a period of no less than 5 years, to be reviewed annually by the Director of Communications & Technology.

The Board’s Committee for Policy & Administration will regularly review this policy. We thank you for your understanding as we navigate a tricky landscape and give our promise to always do the best we can.
